Terms of Service

1. The Service

Flowly ("the Service", "we", "us") is a news aggregation platform, operated by Rifat Rupok, that fetches and displays headlines, excerpts, and thumbnails from publicly available RSS feeds. Flowly does not host, store, produce, or editorially control any of the news content it displays. All such content remains the property of its original publisher. By accessing or using the Service you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service. By using Flowly you represent that you meet this requirement and that your use complies with all laws applicable to you.

3. Beta Period

The Service is currently in public beta. Features, performance, and policies may change without notice. Availability is not guaranteed, and we may pause, limit, or discontinue any feature at any time without liability. See the Beta Disclaimer for details.

4. Acceptable Use

By using Flowly you agree to:

  • Use the Service only for lawful purposes;
  • Not attempt to scrape, crawl, mirror, or republish the Service at scale;
  • Not submit RSS feeds containing illegal, infringing, pornographic, hateful, or deliberately misleading content;
  • Not attempt to circumvent rate limits, security controls, or abuse the refresh mechanism;
  • Not introduce malware or attempt to disrupt, overload, or gain unauthorised access to the Service or its infrastructure;
  • Take full responsibility for any custom RSS sources or other material you submit.

5. User Submissions

When you submit an RSS feed URL or other material, you represent that you have the right to do so and that the submission does not violate any law or third-party right. You grant us a non-exclusive, worldwide, royalty-free licence to use, review, display, and process your submission for the purpose of operating and improving the Service. We may accept, reject, moderate, or remove any submission at our sole discretion and are under no obligation to display it.

6. Third-Party Content & Links

The Service displays and links to content owned and operated by third parties. We do not endorse, and are not responsible for, the accuracy, legality, availability, or quality of any third-party content, feed, or website. When you follow an article link you leave Flowly, and that publisher's own terms and policies apply. Your dealings with any third party are solely between you and that third party.

7. Intellectual Property

The Flowly name, logo, software, design, and original written content (excluding third-party news) are owned by Rifat Rupok and protected by applicable intellectual property laws. Except as permitted by these Terms, you may not copy, modify, distribute, or create derivative works of the Service without prior written permission. See the Copyright Notice.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no guarantee that the Service will be accurate, complete, secure, uninterrupted, timely, or error-free, or that any defects will be corrected. You use the Service, and rely on any content displayed, entirely at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Flowly, its operator (Rifat Rupok), or its contributors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to access or use) the Service or any third-party content — whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the total amount you paid us to use the Service in the twelve (12) months preceding the event giving rise to the claim (which, for a free service, is CAD $0), or (b) CAD $50. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you; in such cases our liability is limited to the smallest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Flowly and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) your use or misuse of the Service; (b) any RSS source or material you submit; or (c) your violation of these Terms or of any applicable law or third-party right.

11. Content Removal

If you are a publisher and believe your content is being displayed in a way that violates your rights, please contact us at contact@rupokri.ca and we will investigate promptly. See the Copyright Notice for the takedown process.

12. Changes to the Service & Terms

We may modify the Service or these Terms at any time. Material changes will be reflected by updating the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including a breach of these Terms. The sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

14. Governing Law

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Manitoba, Canada for any dispute arising out of or relating to these Terms or the Service.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
